RaphaelArtGallery, in accordance with the Art. 10 Law 675/96, declares that the data will be collected with the purpose of registering the user and will be treated in accordance with the laws currently in effect.  The Data can be finalized as required to permit access to services rendered by RaphaelArtGallery.

 

 

 NOTES:

RaphaelArtGallery reserves the right to accept only works that have an indisputable artistic value.

In case of acceptance, the Seller will be required to send a digital photograph high-resolution JPEG format of the work and all relevant information in his possession.

In case of non-acceptance, nothing will be due to the seller.

 

Each work must be accompanied by certificate of authenticity and legitimate documentation of provenance.

The Seller must demonstrate through written declaration, for RaphaelArtGallery and the Buyer, to be the owner of the work or being entitled to sell it from the legitimate owner, namely that he can legally transfer the property and the relative right of ownership free from any claims by Third party and from rights of retention.

 

The Seller must give RaphaelArtGallery mandate to sell the work in question entrusting it with the business of sale’s advising and assisting in the sale.

In this mandate will be specified the selling price of the work, the term of office, the conditions under which is conditional sale and compensation to be paid to RaphaelArtGallery.

  

The commission of Law (Art. 1748 of the Civil Code) due to RaphaelArtGallery for service rendered during the negotiations, the wording of contracts and all action necessary to conclude the sale is valued as much as 10% (excluding VAT), charged on total sales price up to EUR 500.000,00, beyond this figure the amount will be 'equal to' 8% (excluding VAT), charged on the total price of sale.

The Vendor undertakes to pay such a commission to RaphaelArtGallery at the same time of the conclusion of the negotiation.

 

Upon receipt of the mandate for sale, RaphaelArtGallery sends the customer a confirmation message and starts practices necessary for the sale of the work.

 

During the negotiations the work remains in custody of the Seller.

 

The Seller, prior appointment between the Parties and only in order to finalize the sale, must bring the work to the RaphaelArtGallery headquarters or to an agreed place in order to give the Buyer the possibility to inspect the work, to ascertain its conservation status and check the relative documentation.

 

 Unless otherwise agreed, the Seller is responsible for any costs of transporting or shipping of the work before the conclusion of the negotiation.

 

The negotiation, if brought to fruition, culminates with the signing of a contract of purchase and sale between the Parties.

 

If the good remains unsold, by the time of expiry of the mandate, RaphaelArtGallery sends the Seller  notification of sale’s failure and makes him free from any commitment against the agency.

 

To ensure greater confidentiality, RaphaelArtGallery offers the Seller the possibility to:

-- Remain anonymous in the negotiation

-- Insert on the site work specifications (or data sheet of the work) without exposing, unless specifically requested, its photographic reproduction or the selling price.
